Conditions and Agreement for using www.jobthai.com service of Job Seeker, Service Users and/or Members.
Under the conditions and agreements for using this service, any "words" appeared in these conditions and agreements shall have the following meanings, unless otherwise specified.
"Advertisement" shall mean the announcement to find persons to be employed to work in any jobs, including any forms of advertisement as shown in www.jobthai.com.
"Applicant" shall mean the one who applies for vacant positions as advertised in JobThai website.
"Application" shall mean the application that is filled by an interested person applying for the vacant position as advertised on the website.
"Interested person applying for a job" shall mean a person who use this website for the objective of looking for jobs.
"Conditions" shall mean the conditions and/or agreements to be shown as follows.
"CV" or "Resume" shall mean the personal records of interested job seekers as well as educational history, working experiences prepared by applicants themselves that can be given to JobThai with the owners’ consent.
"JobThai" shall mean THiNKNET Co., Ltd., a juristic person No. 0125543004205, located at the address No. 323 United Center Building, 14th floor, suite No. 1402 A, Silom Road, Silom Sub-district, Bang Rak District, Bangkok Metropolis 10500.
"Service" shall mean the services offered on www.jobthai.com website by JobThai with and without expenses as shown in this contract, including the presentation of information and news relating to the benefits of the service users, members, entrepreneurs, interested job seekers and general public.
"Registration" shall mean the process performed by an interested job seeker for JobThai to maintain all details, including CV or resume, on the website for the benefit of job seeking and employment.
"Member" shall mean the one who applies for membership with JobThai and have been given with the login and password.
1.1 Conditions and agreements as mentioned here shall be bound by interested job applicants who use the JobThai service immediately since this conditions and agreements has been posted on the website.
1.2 Interested job applicant has thoroughly read and understood in acceptance of this conditions and agreement during the registration is made on the website or when the application is filled.
2. Scope of service providing
2.1 For security or any other necessities, JobThai may change; revise any services offered to interested job applicants without further notice.
2.2 Any intellectual property, concept, know-how or technique developed, created or acquired during the provision of service shall be deemed as the exclusive right of JobThai.
2.3 JobThai shall not be responsible for the mistakes in providing services or in case the website cannot be accessed if it is under reasonable care and according to circumstances.
2.4 An interested job applicant agrees to deliver information in any form as requested by JobThai for the service benefit.
2.5 An interested job applicant acknowledges that JobThai shall not be responsible for any failure or defect of the service providing, in whole or in part as the result of non-compliance with this conditions and agreements.
2.6 JobThai shall not be bound for the service until the information necessary for providing the service shall be delivered to JobThai.
3. CV and resume
In case the detail of CV and resume has been recorded by the interested job application and allowed to be kept by JobThai.
3.1. Maintenance and delivery of CV or Resume to any entrepreneurs must be consented by an interested job applicant on whether or not the CV or Resume shall be permitted to be forwarded to entrepreneurs JobThai’s duty is to deliver the CV or Resume copies to JobThai’s members for the employment or job seeking objectives only.
3.2 JobThai shall not guarantee for the minimum number of CV or Resume to be viewed by or delivered to members in each day.
3.3 JobThai may notify the members to acknowledge the incorrectness or impropriety of CV or Resume without notifying the interested job applicants for acknowledgement.
3.4 JobThai shall have the absolute right to refuse not to distribute, forward, cancel or take CV or Resume out of the system as given by the interested job applicants.
3.5 JobThai may refuse to withdraw or amend the information or CV of the interested job applicants that are considered against the law, good morality with the obscene and offensive contents or any other information that are considered unlawful and against the JobThai and interested job applicants.
3.6 The interested job applicant acknowledges that
3.6.1 The details and CV or Resume recorded and maintained by JobThai are the correct and genuine, information.
3.6.2 In case the information recorded and kept by JobThai are found to be mistaken or incorrect in any case, JobThai reserves the right for the transfer of information and/or suspension of the service without further notice.
3.6.3 Any CV or Resume delivered to JobThai by the interested job applicants, in whole or in part, or any documents that can prove the existence of other persons, the interested job applications expressly acknowledge that they have the right to use it or for the support of CV or Resume. For this purpose, JobThai shall not be responsible for any damage should it be occurred in case of being sued or demanded for damages compensation as the result of using such names or photos without consent.
4.1 An interested job applicant has thoroughly read and understood the qualifications of the applicant for the vacant positions announced or advertised on the JobThai website.
4.2 An interested job applicant acknowledges that he/she is qualified and skillful according the member’s requirements advertised for that particular job positions.
4.3 An interested job applicant acknowledges and agrees to cooperate (if any) in contacting with the administrative agencies or any places in person according to the member’s desire in order to have it conformed to the job descriptions as having been advertised.
4.4 An interested job applicant acknowledges that all information that are considered as part of the application submitted to the member are all true and correct.
4.5 An interested job applicant acknowledges that in case any information in the application is found to be untrue or against the law and good morality, JobThai reserves the right to cancel or suspend the service given to the interested job application without further notice.
4.6 All the applications delivered to JobThai by the interested job applicants, if they contains names or photos of any persons, in whole or in part or any documents that can prove the existence of other persons, the interested job applicants acknowledge that they have the full right to use them or for the support of the applications. For this purpose JobThai shall not be responsible for any damage in case of being sued or demanded for damages compensation for the use of such names or photos without consent.
4.7 JobThai shall have the absolute right to refuse not to distribute, forward, cancel or take the application out of the system as given by the interested job applicants.
4.8 JobThai may refuse to withdraw or amend the information or applications of the interested job applicants that are considered against the law and good morality with obscene and offensive consents or any other information or applications that are considered unlawful and against the JobThai and interested job applicants.
4.9 Any application prepared on the JobThai website shall be delivered to members who posted the announcement for accepting employment for the objective of using them for the consideration of the vacant position only.
4.10 The interested job applicants understand and acknowledge that JobThai may not be responsible for the advertising contents appeared on the website of JobThai and no obligation should be burdened by JobThai for that purpose.
5. Duties of the interested job applicants
5.1 The interested job applicants shall not disclose the passwords or any other codes (if any) used for the services on JobThai website to other persons whatever the reasons.
5.2 In case the interested job applicants are acting in breach of clause 5.1 above, they will be responsible for the false application of the passwords or any other codes without any excuse.
JobThai shall not be responsible both in term of the contract and/or wrongful act for the following cases:
6.1 The loss of pictures, artworks, copies, information, CV or Resume or any other things given to JobThai by the interested job applicants.
6.2 The mistake or negligence being occurred or would be occurred as the result of the service or the loss of information or damage as the result of improper application of the interested job applicants themselves.
6.3 Directors, brokers, agents or any other persons of JobThai shall not be responsible for the mistake relating to the employment between members and the interested job applicants or applicants.
6.4 The delay, expenses, loss, damage or any liability, including but not limited to the result of the fault of equipment, computer programs, virus, erase or failure of such equipment or any erased information, whatever the cause, if resulted by the application of such equipment of the interested job applicants and it is appeared that reasonable diligence has been fully applied by the JobThai.
6.5 Reliability and correctness of advertising work as appeared on the JobThai website are the satisfaction of the interested job applicants themselves. JobThai shall not be responsible for the mistake or damage occurred as the result of the information appeared in the advertisement on the website.
6.6 JobThai shall not be responsible for the breach of contract, default contract, infringement, any rights of any persons resulted from the information or CV or Resumes or applications delivered by the interested job applicants.
7. Contract termination
7.1 JobThai and interested job applicants can terminate this contract or conditions through the written notice to each other.
7.2 The interested job applicants must be solely responsible for the expenses, damages, lawyer fees, court cost or other expenses occurred as the result of the dispute abatement if it is appeared that the reason for the contract termination is the fault of the interested job applicants.
8. Governing law
This agreements or conditions of service or other contracts relating to this agreement shall be in accordance with and subject to the law of the Kingdom of Thailand only.
